J. David Henderson

Mr. Henderson is an experienced design/construction defect litigator who concentrates his practice on representing licensed and registered design and engineering professionals in high-stakes construction and professional liability matters. His representation generally includes defending licensed and registered design and engineering professionals against malpractice, design/construction defect, breach of contract, and defense and indemnity claims, among other things. He previously practiced construction defect litigation on behalf of contractors and subcontractors, which included, inter alia, defending contractors and subcontractors against construction defect, breach of contract, breach of warranty, negligence, and defense and indemnity claims. As a result, Mr. Henderson has a unique understanding of the design phase, construction process, and risk management methods. He also has a keen aptitude in foreseeing common arguments asserted by contractors against design professionals on the one hand, and by design professionals against contractors on the other.
Mr. Henderson is known for his straightforward communication and aggressive defense strategies. He combines practical industry insight with strategic advocacy to strengthen his clients’ positions and drive efficient resolutions. Mr. Henderson has successfully tried cases to verdict, all of which entailed multi-million-dollar arbitrations where Mr. Henderson secured awards significantly below each claimant’s final demands. He has also been able to obtain favorable settlements in design/construction defect disputes following successful motion practice, including, motions to strike key liability and cost-of-repair experts.
